Lodgement of VCAT appeal – 220 Barkly Street (also known as 120 Donald Street) Footscray

The Maribyrnong City Council released the following update on the VMA .

“The VMA have lodged an appeal at the Victorian Civil and Administrative Tribunal against Council’s refusal to grant an amended planning permit. This is formally known as an appeal pursuant to s77 of the Planning and Environment Act 1987 (the Act). At the same time the VMA have lodged a second appeal seeking a declaration from VCAT that Condition 18 of the permit, which requires a written agreement between the VMA and landowner to the south for relocation of the loading facilities, is in valid. This is formally known as an appeal pursuant to s149B of the Act. Council has requested that the VMA notify all persons who objected to the original permit of the appeals.”
